Die Frage nach der Gerechtigkeit im Gesundheitswesen wird aus der Perspektive einer allgemeinen Theorie der Gerechtigkeit betrachtet. Diese Theorie ist ein Befähigungsansatz, der zwischen 1) der Grundversorgung aller Bürger mit Grundbefähigungen, 2) einem gerechten Anteil an den Früchten gesellschaftlicher Kooperation und 3) individuell erstrebten Gütern und Leistungen differenziert. Die Anwendung dieser Theorie reagiert auf charakteristische Probleme der Allokation im Gesundheitssektor: den prinzipiell ungedeckten Bedarf, die mangelnde Zurechenbarkeit des Bedarfes und die asymmetrische Informationsstruktur zwischen Patienten und Leistungserbringern.

According to a two-level criterion for combination tests in the field of ordinary language, moral 'ought'-sentences may be taken to imply 'I intend'-sentences partly semantically and partly pragmatically. If so, a trenchant linguistic analysis of the concept of moral obligation cannot do without a non-classical logic which allows to model these important kinds of ordinary-language implications by means of purely syntactical derivations. For this purpose, an integrated logic of conviction and intention has been tentatively devised by way of a doxastically, (...) buletically, and pragmatically extended calculus of natural deduction. This system of buletic logic cannot even be launched without one or two derivation rules of deductive closedness. However, these very closedness rules appear to be responsible for buletic paradoxes which are analogous to paradoxes long since known from other, less exotic branches of logic but at first sight look much more virulent. After having scrutinized two potential strategies for coping with the paradoxes of buletic logic, finally we can convince ourselves that these paradoxes, as well as their familiar non-buletic counterparts, are but apparent paradoxes, provided we consistently lean on C-CT and do not let pragmatical considerations intrude into purely logical ones. The study of biodiversity spans many disciplines and includes data pertaining to species distributions and abundances, genetic sequences, trait measurements, and ecological niches, complemented by information on collection and measurement protocols. A review of the current landscape of metadata standards and ontologies in biodiversity science suggests that existing standards such as the Darwin Core terminology are inadequate for describing biodiversity data in a semantically meaningful and computationally useful way. Existing ontologies, such as the Gene Ontology and others in the Open (...) Biological and Biomedical Ontologies (OBO) Foundry library, provide a semantic structure but lack many of the necessary terms to describe biodiversity data in all its dimensions. In this paper, we describe the motivation for and ongoing development of a new Biological Collections Ontology, the Environment Ontology, and the Population and Community Ontology. These ontologies share the aim of improving data aggregation and integration across the biodiversity domain and can be used to describe physical samples and sampling processes (for example, collection, extraction, and preservation techniques), as well as biodiversity observations that involve no physical sampling. Together they encompass studies of: 1) individual organisms, including voucher specimens from ecological studies and museum specimens, 2) bulk or environmental samples (e.g., gut contents, soil, water) that include DNA, other molecules, and potentially many organisms, especially microbes, and 3) survey-based ecological observations. We discuss how these ontologies can be applied to biodiversity use cases that span genetic, organismal, and ecosystem levels of organization. We argue that if adopted as a standard and rigorously applied and enriched by the biodiversity community, these ontologies would significantly reduce barriers to data discovery, integration, and exchange among biodiversity resources and researchers. The notion of caring is extremely problematic in the way that it is defined, practised and promoted. In response to Gorovitz I have attempted to go beyond the discussion of how health care workers can promote care at an organisational level, and look at some of the paradoxical elements of caring as it is currently being described. These paradoxes arise, in part, from the current emphasis on individualism in Western society which has made the notion of ‘mass care’ unacceptable because (...) it fails to acknowledge individual differences in patients. If we acknowledge patients as individuals, however, we must also acknowledge practitioners as unique persons too, and we therefore need to be very careful about subjecting them to the same type of generalised prescriptions to which we have subjected patients in the past.A form of care which is not detached and impersonal is being advocated it seems, but it is unlikely that anyone would want health care workers to become inextricably emotionally entwined with their patients. Plotting out the middle ground, however, is difficult to do without recourse to generalised principles. These principles are extremely valuable in the way that they can shape policy and the planning of services, but they are difficult to apply to the relationships between individual staff and patients simply because they are generalised rather than specific. In using these principles, therefore, we can only determine the general context in which caring takes place, and not the nature of this caring.These problems and paradoxes seem, at the moment, to be inherent in caring as it has been recently portrayed. It may be possible to resolve them, or find ways out of these dilemmas, but this can only be done by a very careful examination of motivations and values. In the meantime we may have to be less ambitious in our aspirations, and think about how to define acceptable, rather than ideal standards of care. (shrink)

Die prospektive Analyse der ethischen Implikationen medizinisch-technischer Innovationen läuft immer auch Gefahr, sich in den Wunschbildern von Marketingexperten zu verfangen. Vor diesem Hintergrund könnte es durchaus nützlich sein, die Erkenntnisse der Wissenschafts- und Technikforschung zur Genese und Entwicklung neuer Techniken auszuschöpfen. Dies erscheint gerade auch für die ins Phantastische weisende Zukunft der Individualisierung medikamentöser Therapie, wie man ihr häufig in der Beschreibung pharmakogenetischer Behandlungskonzepte begegnet, angebracht. Techniken, die sich noch im Entwicklungsstadium befinden und deren breite Anwendung noch einige Jahre auf (...) sich warten lassen wird, sollten sehr sorgfältig auf ihren Realitätsgehalt und das zu erwartende Leistungspotenzial hin analysiert werden. Dazu gehört v. a. auch eine kritische Auseinandersetzung mit den Leitbildern, Visionen und Nutzenversprechen, mit denen technische Innovationen oft sehr absichtsvoll ausgestattet werden. Wird dabei die Distanz zur Rhetorik der Protagonisten der neuen Techniken nicht gewahrt, gerät die ethische Reflexion unvermittelt in die Rolle, profane Marketingstrategien wortgewandt und ideenreich zu veredeln. In the first chapter I have introduced Carnapian intensional logic against the background of Frege's and Quine's puzzles. The main body of the dissertation consists of two parts. In the first part I discussed Carnapian modal logic and arithmetic with descriptions. In the second chapter, I have described three Carnapian theories, CCL, CFL, and CNL. All three theories have three things in common. First, they are formulated in languages containing description terms. Second, they contain a system of modal logic. Third, (...) they do not contain the unrestricted classical substitution principle, but they do contain the classical substitution principle restricted to non-modal formulas and the Carnapian substitution principle, which says that two terms can be substituted salva veritate if they are necessarily coreferential. There are two major differences between the three theories. First, CCL and CFL allow universal instantiation with description terms, whereas CNL does not. Moreover, the quantificational theory of the CCL is classical, whereas the quantificational theory of CFL is a free logic. Another difference is that CCL and CFL contain different description principles. Most importantly, the description principle of CCL ensures that even improper descriptions have a denotation, whereas the description principle of CFL does not guarantee this. CNL does not have a description principle. In the third chapter, I have studied collapse arguments for CCL, CFL, and CNL. A collapse argument is an argument for the following statement: if p is true, then it is necessarily true. A crucial role in the proofs of these collapse results was played by so-called self-predication principles, which say that under certain conditions the predicate that expresses the descriptive condition can be combined by the description term formed out of that predicate with the result being a true sentence. In this chapter I have discussed a collapse argument for the extension of CCL with a self-predication principle, I have given a collapse argument for a similarly extended CFL, and most importantly, I have given a collapse argument for the extension of CNL with a self- predication principle. Finally, I have argued that the relevant self-predication principles are unsound under a Carnapian interpretation. In the fourth chapter, I have studied the extension of Peano Arithmetic with a Carnapian modal logic C, which is a dummy letter standing for either CCL or CFL. One can prove that the principle of the necessity of identity is a theorem of CPA. This implies that one gets a collapse result for CPA. The standard principle of weak induction was crucial for the proof. One can also prove that, if one assumes a particular self-predication principle, and if one assumes the principle of strong induction or, equivalently, the least-number principle, then one gets a partial collapse of de re modal truths in de dicto modal truths. I have argued that, if the box operator is interpreted as a metaphysical necessity operator, then Platonists would not be inimical to the collapse result. But if CPA is extended with a physical theory, then there is a threat that physical truths become physical necessiti es. It was shown that, under a Carnapian interpretation, the standard principle of weak induction is unsound, and that it can be replaced by a Carnapian principle of weak induction that is sound. The problem of logical and mathematical omniscience prevents ordinary Carnapian intensional logic from being taken seriously as a logic adequate for describing the principles of demonstrability. Yet many of the proof-theoretic results of the first part carry over to the part on Carnapian epistemic arithmetic with descriptions, since proof-theoretic results are independent of the informal reading of the operators. In the fifth chapter, I looked at extensions of arithmetic with a modal logic in which the box operator is interpreted as a demonstrability operator. A first extension in that sense is Shapiro s Epistemic Arithmetic. Shapiro himself offered the problem of mathematical omniscience as a reason why it is difficult to find a model theory for EA. Horsten attempted to provide a model theory via the detour of Modal-Epistemic Arithmetic. The attention of the reader was drawn to an incoherence in the model theory of. Two alternative solutions were presented and, after a short discussion of the problem of de re demonstrability one of those alternatives was chosen. The discussion of the problem of de re demonstrability made it clear that it would be interesting to study the epistemic properties of notation systems. Horsten himself provided a framework for this, viz. Carnapian Epistemic Arithmetic, and he started a systematic study of the epistemic properties of notation systems within that framework. However, he did not provide non-trivial but adequate models. To make a start with solving the problem of finding good models for CEA, I introduced Carnapian Modal-Epistemic Arithmetic In constructing CMEA I incorporated the lesson about the principle of weak induction learnt in the fourth chapter. In the sixth chapter, I gave a critical assessment of an argument concerning the limits of de re demonstrability about the natural numbers. The conclusion of the Description Argument is that it is undemonstrable that there is a natural number that has a certain property but of which it is undemonstrable that it has that property. A crucial step in the Description Argument involved a self-predication principle. Making good use of one of the results obtained in the third chapter, I proved a collapse result for the background theory against which the Description Argument was formulated. I concluded that either the either the Description Argument is sound but its conclusion is trivial, o r the Description Argument is unsound, or it is a cheapshot. As an appendix I included an article co-authored by prof. dr. Leon Horsten and me. The topic of the article is indirectly related to some other topics investigated in my dissertation. Also, it backs up one of the addition al theses I might be asked to publicly defend during my doctoral exam. T he topic of the appendix is the set of the so-called paradoxes of strict implication. Jonathan Lowe has argued that a particular variation on C.I. Lewis notion of strict implication avoids the paradoxes of strict implication. Pace Lowe, it is argued that Lowe s notion of implication does not achieve this aim. Moreover, a general argument is offered to the effect that no other variation on Lewis notion of constantly strict implication describes the logical behaviour of natural language conditional s in a satisfactory way. In his 1993 novel Headhunter, Canadian author Timothy Findley describes the tendency of some medical practitioners to put scientific interests above the therapeutic needs of the individual. As the book's title and name of the main character Dr. Kurtz attest, Findley reflects the colonialist teleology found in Heart of Darkness as an analogue for the therapeutic zeal shown by many of the physicians in Headhunter. In the novel, such zeal is especially problematic when it is combined with so-called enhancement technologies, (...) since enhancement, like colonialism, can be based in the prejudices of the practitioner and/or the dominant society, rather than in the needs of the patient. To counter therapeutic zeal, Findley, like Conrad, proposes an ethics of restraint in which the practitioner's empathy outweighs his or her desire for scientific discovery. (shrink)

No one is surprised anymore by the dialogue between Buddhism and Western science, which develops the foundations of cognitive and contemplative sciences. But there have been requests for reflection on the results achieved, or even for a strategy for analytical research of the Buddhist East, which brings this dialogue to the philosophical level. And this level of discussion is, in fact, the dialogue between Buddhism and Western philosophy, which requires a new discourse that should be built on their common ground. (...) And the first question that arises against this background is how to focus attention on the philosophical aspect of Buddhism, which orientalists usually call “Buddhist philosophy”. Thus, realizing the beginning of the dialogue between Buddhist and Western philosophies, we are faced with the need to take the next, but already conscious step in the direction of this discussion. In order to make this step confident, we need to know where and how to start, and what key subjects we can rely on. Therefore, in an effort to find possible warnings against gross mistakes in such discussions, we sought the help of Western experts in the field of Buddhist studies by reading their works and talking to them. One of the well-known scholars is Professor Jan Westerhoff, who kindly agreed to give me an interview and answer some questions: whether there is a Buddhist philosophy; what are the approaches and stages of its research; what are the peculiarities of using the terms of Western philosophy in these studies; what can be the criterion for the best reading of traditional Buddhist texts; what can such a discussion give to contemporary Western philosophy, etc. This interview was not intended to be a conceptual deepening of either Buddhist or Western philosophy; we only tried to identify key questions that could start a dialog between them in the right direction. In this interview with Jan Hendrik van den Berg, the Dutch phenomenologist and psychiatrist addresses the origins of his work, his most significant influences, and the purpose of metabletic phenomenology in the modern age. In the course of the interview. Dr. Van den Berg provides a basic overview of his work, and highlights the central finding of his metabletic analyses: a loss of wonder before nature, which results from the more fundamental loss of genuine spirituality in the modern world.

According to recent commentators like Paul Guyer, Kant agrees with Hume's Dialogues Concerning Natural Religion that physico-theology can never provide knowledge of God and that the concept of God, nevertheless, provides a useful heuristic principle for scientific enquiry. This paper argues that Kant, far from agreeing with Hume, criticizes Hume's Dialogues for failing to prove that physico-theology can never yield knowledge of God and that Kant correctly views Hume's Dialogues as a threat to, rather than an anticipation of, his own (...) view that the concept of God provides a useful heuristic principle for science. The paper concludes that Kant's critique of physico-theology reflects Kant's deep dissatisfaction with Hume's manner of argumentation and suggests that Kant's attempt to provide a more successful critique of physico-theology merits continued philosophical attention. Abstractabstract:Kant's treatment of infinity seems to be plagued by two contradictions. First, the Transcendental Aesthetic claims that space is an infinite given magnitude, whereas the First Antinomy argues that the spatial world cannot be infinite. Second, the Transcendental Aesthetic claims that the representation of infinite space belongs to sensibility, but the third Critique seems to argue, instead, that infinity is an Idea of reason. This paper resolves these apparent contradictions by noting that Kant groups his various conceptions of space into (...) three kinds: (1) merely subjectively given space, (2) objectively given space, and (3) objective space as a mere Idea. Attending to these three conceptions of space illustrates that the Transcendental Aesthetic, First Antinomy, and third Critique refer to different conceptions of infinite space and thus do not contradict one another, illuminating the importance of Kant's various conceptions of space for his critical project. In this paper, we present a survey of the development of the technique of argument diagramming covering not only the fields in which it originated - informal logic, argumentation theory, evidence law and legal reasoning – but also more recent work in applying and developing it in computer science and artificial intelligence. Beginning with a simple example of an everyday argument, we present an analysis of it visualised as an argument diagram constructed using a software tool. In the context of (...) a brief history of the development of diagramming, it is then shown how argument diagrams have been used to analyze and work with argumentation in law, philosophy and artificial intelligence. A familiar post-Kantian criticism contends that Kant enslaves sensibility under the yoke of practical reason. Friedrich Schiller advanced a version of this criticism to which Kant publicly responded. Recent commentators have emphasized the role that Kant’s reply assigns to the pleasure that accompanies successful moral action. In contrast, I argue that Kant’s reply relies primarily on the sublime feeling that arises when we merely contemplate the moral law. In fact, the pleasures emphasized by other recent commentators depend on this sublime (...) feeling. These facts illuminate Kant’s views regarding the relationship between morality, freedom, and the development of moral feelings. (shrink)

Stephenson (2022) has argued that Kant’s thesis that all transcendental truths are transcendentally a priori knowable leads to omniscience of all transcendental truths. His arguments depend on luminosity principles and closure principles for transcendental knowability. We will argue that one pair of a luminosity and a closure principle should not be used, because the closure principle is too strong, while the other pair of a luminosity and a closure principle should not be used, because the luminosity principle is too strong.
